Terms of use

1. Introduction

This document contains important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that may apply to you. Please read it carefully. These Terms of Use ("Terms") govern your access to and use of the Fixxr platform ("Platform", "App", "we", "us", or "our"). By using the Platform, you agree to be bound by these Terms.

By using this App, you confirm that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• If acting on behalf of a company, you are authorised to bind that entity.

You may not use the Platform if you do not agree to these Terms or are prohibited by applicable South African law.

2. Nature of the Platform

Fixxr is a neutral online marketplace that connects customers ("Clients") with independent service providers ("Mechanics"). Fixxr does not provide services directly and does not control, supervise, or direct Fixers. We make no guarantees regarding:

• The quality of services;
• The qualifications or licensing of Fixers;
• Outcomes of any services rendered.

All services are provided at your own risk.

3. Orders and Services

Any booking made through the Platform constitutes an offer to procure services under these Terms. Fixxr reserves the right to accept or reject any booking at its discretion. Fixxr facilitates transactions but is not a party to the agreement between Clients and Mechanics.

4. Pricing and Payment

• All prices displayed are subject to change without notice.
• Prices may exclude VAT unless stated otherwise.
• Final pricing will be confirmed at checkout.

By making a booking, you warrant that:

• Your payment details are accurate;
• You are authorised to use the payment method;
• You will honour all charges incurred.

Fixxr may:

• Collect payments on behalf of Mechanics; and
• Remit a portion to Mechanics after completion of services.

5. Refunds and Cancellations

Refunds are granted at Fixxr’s sole discretion and are subject to our specific guidelines. Generally:

• Refunds may be issued if a service is not performed. For full details, please review our Refund Guidelines;
• No-shows may result in fees;
• Late cancellations may not be refundable. Please refer to our Cancellation Guidelines for exact timeframes and penalties.

6. User Conduct

You agree to use the Platform lawfully and not to:

• Misrepresent information;
• Engage in harmful, abusive, or fraudulent conduct;
• Interfere with the operation of the Platform.

We may suspend or terminate access at our discretion.

7. Independent Contractor Status (Mechanics)

Mechanics are independent contractors and not employees, partners, or agents of Fixxr. Mechanics are solely responsible for:

• Compliance with all applicable South African laws;
• Tax obligations (including income tax and VAT where applicable);
• Insurance and licensing requirements.

Fixxr is not responsible for PAYE, UIF contributions, or any statutory obligations relating to Fixers.

8. Service Provider Obligations

Mechanic warrant that they:

• Have the necessary skill, experience, and qualifications;
• Will perform services professionally and lawfully;
• Will comply with all applicable regulations.

Mechanic’s indemnify Fixxr against any claims arising from:

• Their services;
• Injury, death, or property damage;
• Breach of these Terms.

9. Limitation of Liability

To the maximum extent permitted under South African law:

• Fixxr is not liable for disputes between users;
• Fixxr is not liable for indirect, incidental, or consequential damages;
• Fixxr is not liable for any injury, loss, or damage arising from services arranged through the Platform.

Mechanic’s total liability shall not exceed the amount paid for the specific service.

10. Disclaimer of Warranties

The Platform and all services are provided "as is" and "as available". Fixxr makes no warranties regarding:

• Accuracy or reliability of services;
• Service provider competence;
• Outcomes of any work performed.

11. Assumption of Risk

You acknowledge that services arranged through the Platform may involve risks, including:

• Personal injury;
• Property damage;
• Financial loss.

You assume all such risks and release Fixxr from liability to the fullest extent permitted by law.

12. Privacy

Your personal information is processed in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

14. Dispute Resolution

Where possible, disputes should first be resolved informally. If unresolved:

• Disputes may be referred to arbitration in South Africa; or
• A competent South African court may have jurisdiction, subject to applicable law.

Nothing in these Terms limits your rights under the Consumer Protection Act (CPA).

15. Consumer Protection

Nothing in these Terms is intended to limit or waive any rights you may have under applicable South African consumer protection laws, including the Consumer Protection Act.

16. Electronic Acceptance

Use of the Platform constitutes electronic acceptance of these Terms and forms a binding agreement under the Electronic Communications and Transactions Act.

17. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.

18. General Provisions

• You may not assign your rights without consent;
• If any provision is invalid, the remainder remains enforceable;
• These Terms constitute the entire agreement between you and Fixxr.
